Until recently, I had always believed that if a person was arrested, or became a defendant in a case, he or she must have done something wrong to get in that position. A law enforcement agency must have done an investigation and obtained information about him that I am not privy to. They certainly would not waste their time unless they had evidence of his guilt. After all, I watched "Law and Order" religiously. I know how it all happens. Anyway, all an innocent defendant has to do is to present their defense and evidence at trial. Once the jury sees it, the defendant will be found not guilty. Right?
Unfortunately, television lies. A real criminal proceeding is entirely different from what they show on "Law and Order".
It was Mark Twain who said, "The difference between the almost-right word and the right word is really a large matter -- it's the difference between the lightning bug and the lightning."
Many defendants can attest to that-they are being sentenced to Federal prison for making false statements or for perjury convictions based on the culmination of a string of "almost-right" words, rather than the product of clear and convincing evidence, or properly stated facts.
